Welcome to HEADBAG. These Terms & Conditions govern your use of our website, en.headbag.com.ua, and the purchase of products from our online store.

By accessing our website, placing an order, or completing payment, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, as well as our Privacy Policy, Shipping Policy, and Returns & Exchanges Policy.

If you do not agree with these terms, please do not use this website or place an order.

2. Products and Product Information

We sell tactical clothing, apparel, accessories, and related products through our website.
We make reasonable efforts to ensure that product descriptions, specifications, sizes, colors, images, and prices are accurate. However:

  • Product colors may appear differently depending on your screen, device settings, lighting, or photography.
  • Measurements shown in the Size Guide are approximate and may vary slightly between product batches.
  • Product packaging, labels, design details, accessories, or materials may be updated by the manufacturer without prior notice, provided that the product’s main characteristics are not materially affected.
  • Availability is not guaranteed until the order is accepted and payment has been confirmed.
Before purchasing, please review the product description and Size Guide carefully. If you need help selecting a size, contact us before placing your order.

3. Orders and Contract Formation

Placing an order on our website constitutes an offer by you to purchase the selected product(s) under these Terms & Conditions.
After submitting your order, you will receive an automated order confirmation by email. This confirmation acknowledges that we received your order; it does not necessarily mean that the order has been accepted, packed, or dispatched.
The purchase contract is considered concluded when we confirm your order and accept the payment, or when we dispatch the order, whichever occurs first.

We reserve the right to refuse, cancel, or limit an order before dispatch if:

  • The requested item is unavailable.
  • Payment cannot be verified, is declined, reversed, or appears fraudulent.
  • The order contains incorrect pricing, product information, or a technical error.
  • The shipping address is incomplete, incorrect, or outside our delivery area.
  • The order cannot be shipped due to carrier, customs, export, security, sanctions, or legal restrictions.
  • We reasonably suspect resale, abuse, fraudulent activity, or a violation of these Terms & Conditions.
If we cancel an order after payment has been received, we will issue a refund to the original payment method where possible.

4. Prices and Payment

All prices are displayed in USD unless otherwise stated.
Full prepayment is required for all orders. We begin processing an order only after successful payment confirmation.
Available payment methods are displayed at checkout. By submitting payment information, you confirm that you are authorized to use the selected payment method.
Product prices and shipping costs are shown at checkout before payment. Unless expressly stated otherwise, product prices and delivery charges do not include import duties, customs fees, taxes, import VAT, brokerage charges, or other fees imposed by the destination country.
We reserve the right to correct obvious pricing or technical errors. If an incorrect price affects your order, we will contact you before processing it or cancel the order and refund any payment received.

5. International Shipping

We ship orders from Ukraine to selected international destinations.
Orders are normally processed within 1–3 business days after payment confirmation, unless the product page states otherwise. Processing and delivery times are estimates only and are not guaranteed.
Shipping methods, available carriers, estimated delivery times, and shipping charges are displayed at checkout or communicated before dispatch.
Once your order has been shipped, we will send a dispatch confirmation and tracking number, where tracking is available.

Delivery may be delayed due to circumstances outside our reasonable control, including:

  • Customs inspections and customs-clearance procedures.
  • Carrier delays or local postal-service delays.
  • Public holidays, weather conditions, security restrictions, or transportation disruptions.
  • Incomplete or inaccurate recipient information.
  • Force majeure events.

6. Customs Duties and Import Taxes

Orders are shipped internationally from Ukraine. Depending on the destination country and order value, your shipment may be subject to customs duties, import VAT, taxes, handling charges, brokerage fees, or other local charges.
Unless explicitly stated otherwise at checkout, these charges are not included in the product price or shipping fee.
The customer is solely responsible for paying all applicable customs duties, taxes, import charges, and clearance fees required by the destination country.
If you refuse to pay customs charges, refuse delivery, fail to provide requested customs information, provide an incorrect address, or fail to collect the parcel, the shipment may be returned to us or abandoned by the carrier. Any refund may be reduced by outbound shipping costs, return shipping costs, customs charges, storage fees, handling costs, and other non-refundable expenses incurred by us.
International carriers and postal operators may require accurate sender-provided customs data and may apply destination-country import charges to commercial shipments.

7. Delivery Address

You are responsible for providing a complete, accurate, and deliverable shipping address.
Please enter all address details in Latin characters where required by the carrier, including:

  • Recipient’s full name.
  • Street address and building number.
  • Apartment, unit, office, or floor number, if applicable.
  • City, region/state/province, and postal code.
  • Country.
  • A valid email address and phone number with country code.
We are not responsible for failed delivery, delays, additional charges, or lost parcels caused by an inaccurate, incomplete, inaccessible, or undeliverable address supplied by the customer.

If you need to correct your shipping address, contact us immediately at Kom.pro095@ukr.net. Address changes cannot be guaranteed after the order has been processed or dispatched.

8. Returns and Exchanges

Our Returns & Exchanges Policy forms part of these Terms & Conditions.
You may request a return or exchange within 14 calendar days after receiving your order, subject to applicable law and the conditions stated in our Returns & Exchanges Policy.
To qualify, returned items must generally be unused, unworn, unwashed, undamaged, and returned with original tags, packaging, accessories, and documentation.
For change-of-mind returns, incorrect size selection, or unwanted items, the customer is responsible for return shipping costs to Ukraine, as well as any applicable customs or carrier charges.
Customized, personalized, altered, made-to-order, final-sale, or hygiene-sensitive items may be excluded from returns or exchanges to the extent permitted by applicable law.
Original shipping charges, express-shipping charges, customs duties, import taxes, and third-party service fees are non-refundable unless the item is defective or we sent an incorrect item.
Please do not send any product back without first contacting us and receiving return instructions.

9. Damaged, Defective or Incorrect Items

Please inspect your order immediately upon delivery.
If you receive an incorrect, damaged, or defective item, contact us at Kom.pro095@ukr.net within 48 hours of delivery. Include your order number, a description of the issue, and clear photos or videos of:

  • The product.
  • The damage or defect.
  • The outer parcel and internal packaging.
  • The shipping label.
Do not discard the packaging until we review the claim, as it may be needed for a carrier investigation.
Where a claim is confirmed, we may offer a replacement, repair, partial refund, full refund, or another reasonable solution, depending on the circumstances and product availability.

10. Cancellations

You may request cancellation by contacting us at Kom.pro095@ukr.net as soon as possible.
We can only cancel an order before it has been packed, processed for dispatch, or handed over to the carrier. Once an order has been dispatched, it can only be handled under our Returns & Exchanges Policy.
Orders for customized, personalized, altered, or made-to-order items may not be cancellable once production or preparation has begun.

11. Intellectual Property

All content on this website, including text, product descriptions, graphics, logos, photographs, videos, design elements, website layout, and trademarks, is owned by or licensed to HEADBAG and is protected by applicable intellectual-property laws.
You may not copy, reproduce, republish, distribute, modify, reverse-engineer, or use any content from this website for commercial purposes without our prior written permission.

12. Acceptable Use

You agree not to use our website for any unlawful, fraudulent, harmful, or unauthorized purpose.
You must not:

  • Attempt to interfere with website security or functionality.
  • Use automated tools to scrape, copy, overload, or disrupt the website without authorization.
  • Submit false, misleading, or fraudulent order details.
  • Use another person’s payment method without authorization.
  • Resell products in a manner that misrepresents your relationship with our brand.
  • Upload or transmit malicious code, viruses, or harmful material.

13. Limitation of Liability

To the maximum extent permitted by applicable law, HEADBAG will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or services.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited, including applicable consumer rights.
Our products are intended for their stated purpose only. Tactical clothing and accessories are not a substitute for certified personal protective equipment unless a product is expressly identified and certified as such.
Always assess whether a product is suitable for your intended use, environment, operational requirements, and local regulations.

14. Privacy

We collect and process personal information in accordance with our Privacy Policy.
By placing an order, you acknowledge that we may use your contact and delivery information to process payment, fulfill the order, arrange shipment, provide customer support, comply with legal obligations, and communicate about the order.
For international shipping, we may share necessary information with payment providers, shipping carriers, customs brokers, postal operators, and public authorities where required for delivery and customs clearance.

15. Governing Law and Disputes

These Terms & Conditions are governed by the laws of Ukraine, unless mandatory consumer-protection laws in your country of residence provide otherwise.
If you have a complaint, please contact us first at Kom.pro095@ukr.net. We will make reasonable efforts to resolve the issue promptly and fairly.
Nothing in these Terms & Conditions limits any mandatory consumer rights that apply under the law of your country of residence.

We may update these Terms & Conditions from time to time. The current version will always be published on this page with the “Last updated” date.
Changes will apply to orders placed after the revised Terms & Conditions are published. Orders already accepted will generally remain subject to the version in force at the time of purchase, unless a change is required by law.
